TERMS OF SERVICE

These Terms of Service (“Terms”) govern the purchase and use of photography, imaging, and real estate media services provided by Eagle Eye Imagery (“EE Imagery,” “we,” “us,” or “our”) and the use of www.eeimagery.com.

By booking, purchasing, or using our services, the person or entity requesting the services (“Client,” “you,” or “your”) agrees to these Terms.

1. SERVICES

EE Imagery provides professional real estate photography and related media services throughout the North Shore, Essex County, Greater Boston, and surrounding Massachusetts areas.

Services may include:

  • HDR real estate photography

  • Interior and exterior photography

  • Aerial/drone photography

  • Matterport 3D tours

  • Floor plans

  • Virtual twilight photography

  • Image enhancement and editing

  • Sky replacement

  • Grass greening

  • Marketing materials

  • Other real estate media services offered by EE Imagery

The specific services, quantities, pricing, and deliverables for each project are determined by the services selected when the Client books or orders the project.

2. BOOKING AND SCHEDULING

Appointments are subject to availability and are not guaranteed until confirmed by EE Imagery.

The Client is responsible for providing accurate:

  • Property address

  • Contact information

  • Requested services

  • Access instructions

  • Appointment information

  • Property-specific requirements

EE Imagery may contact the Client if additional information is required to complete an appointment.

Appointment times represent our reasonable scheduling expectations. Arrival times may be affected by traffic, weather, previous appointments, property-access issues, or other circumstances beyond our reasonable control.

3. PROPERTY ACCESS

The Client is responsible for ensuring that EE Imagery has safe and timely access to the property at the scheduled appointment time.

This includes providing any necessary:

  • Lockbox codes

  • Door codes

  • Keys

  • Gate instructions

  • Building-access information

  • Agent or homeowner contact information

  • Parking instructions

If the photographer cannot gain access to the property, substantial delays occur, or access has not been properly arranged, the appointment may need to be rescheduled and a rescheduling or trip fee may apply.

The Client represents that they have the authority to authorize EE Imagery and its personnel to enter and photograph the property.

4. PROPERTY PREPARATION

Properties should be clean, staged, and photography-ready before the photographer arrives.

The Client, property owner, listing agent, or their representatives are responsible for preparing the property.

Preparation may include:

  • Turning on appropriate interior lights

  • Opening blinds or window treatments where desired

  • Removing unnecessary personal items

  • Clearing countertops

  • Removing trash containers

  • Removing vehicles when appropriate

  • Securing pets

  • Completing landscaping or exterior preparation

  • Completing staging before the appointment

Our photographers are not responsible for cleaning, staging, moving furniture, making beds, performing landscaping, or extensively rearranging personal property.

Minor adjustments may be made at the photographer's discretion when practical.

5. OCCUPANTS, CHILDREN AND PETS

The Client is responsible for coordinating with homeowners, tenants, occupants, contractors, and other persons who may be present at the property.

Pets must be appropriately secured when necessary to allow our photographer to work safely and efficiently.

EE Imagery may decline to enter or continue working in an environment that presents an unreasonable safety risk.

6. HDR REAL ESTATE PHOTOGRAPHY

EE Imagery uses professional capture and post-production techniques designed to create polished, natural-looking real estate imagery.

Editing may include:

  • Exposure blending

  • Highlight and shadow correction

  • White-balance correction

  • Color correction

  • Perspective correction

  • Lens correction

  • Window exposure balancing

  • Sharpening

  • Noise reduction

  • Minor object or blemish cleanup

  • Sky enhancement or replacement where appropriate

Final photographs represent EE Imagery's professional interpretation of the property.

Photography is intended to present the property attractively while maintaining a reasonable representation of its appearance.

7. IMAGE RETOUCHING AND PROPERTY ALTERATIONS

Standard editing does not include extensive digital alteration of the property unless specifically ordered or agreed upon.

Requests involving substantial object removal, structural alterations, major landscaping changes, virtual staging, or other significant manipulation may require additional fees.

The Client is responsible for determining whether digitally modified imagery complies with applicable MLS rules, advertising requirements, brokerage policies, or disclosure obligations.

8. DRONE PHOTOGRAPHY

Drone photography is subject to applicable federal, state, and local laws and regulations, airspace restrictions, weather conditions, safety considerations, and operational limitations.

EE Imagery will determine whether a drone operation can be conducted safely and legally.

Aerial services may be postponed, modified, or canceled because of conditions including:

  • Rain

  • High winds

  • Poor visibility

  • Thunderstorms

  • Temporary flight restrictions

  • Controlled or restricted airspace

  • FAA restrictions

  • Unsafe launch or recovery areas

  • People, vehicles, structures, utilities, or other hazards

The photographer or remote pilot has final authority regarding whether a drone operation can safely and legally be conducted.

When drone photography cannot be completed during the original appointment, EE Imagery may arrange another opportunity to capture the aerial portion of the project when practical.

9. WEATHER

Real estate photography is affected by weather and environmental conditions.

EE Imagery may photograph a property during cloudy or overcast conditions when professional-quality results can still reasonably be produced.

Weather-related considerations may include:

  • Rain

  • Snow

  • Fog

  • Wind

  • Extreme temperatures

  • Storm conditions

  • Poor visibility

  • Unsafe road conditions

  • Drone restrictions

EE Imagery reserves the right to postpone an appointment when conditions create a safety concern or make the requested service impractical.

The Client may request weather-related rescheduling subject to our cancellation and rescheduling policies.

10. VIRTUAL TWILIGHT

Virtual twilight images are digitally created representations designed to simulate the appearance of a property during twilight.

Virtual twilight editing may include:

  • Twilight sky replacement

  • Interior window illumination

  • Exterior lighting enhancement

  • Landscape lighting effects

  • Exposure adjustments

  • Color and atmospheric adjustments

Virtual twilight photographs are digitally enhanced and do not necessarily represent the actual lighting or environmental conditions at the property at a particular time.

The Client is responsible for complying with any applicable MLS or advertising disclosure requirements regarding digitally altered or virtually enhanced images.

11. MATTERPORT 3D TOURS

Matterport services may include creation of an interactive 3D representation of the property using Matterport technology.

The Client understands that Matterport tours may be hosted through third-party systems and require continued availability of those systems.

Matterport tours may capture portions of a property in considerable detail. The Client is responsible for removing or concealing:

  • Confidential documents

  • Personal photographs if privacy is a concern

  • Financial information

  • Security information

  • Alarm codes

  • Computer screens

  • Personal identifying information

  • Other items the Client does not want visible

EE Imagery is not responsible for personal or confidential items left visible within a property.

Hosting duration, continued hosting, reactivation, or extended hosting may be subject to additional terms or fees.

12. FLOOR PLANS AND MEASUREMENTS

Floor plans supplied by EE Imagery are intended primarily for real estate marketing and informational purposes.

Measurements and calculated areas are approximate.

Floor plans are not architectural drawings, surveys, appraisals, engineering documents, or construction plans and should not be relied upon for those purposes.

Dimensions may differ from measurements produced by an architect, appraiser, assessor, contractor, surveyor, or other professional.

Clients and prospective buyers should independently verify dimensions and square footage when accuracy is material to their decision.

13. CANCELLATIONS AND RESCHEDULING

We understand that real estate schedules change.

Clients should provide as much advance notice as reasonably possible when canceling or rescheduling an appointment.

EE Imagery reserves the right to charge a cancellation, rescheduling, or trip fee for appointments canceled with insufficient notice, properties that are inaccessible, properties that are not reasonably ready for photography, or situations in which our photographer has already traveled to or arrived at the property.

Weather-related rescheduling will be handled reasonably based on the circumstances and the services being performed.

EE Imagery may waive or modify fees at its discretion.

14. PRICING

Current pricing is displayed on our website or provided through our booking system, quotation, invoice, or other written communication.

Pricing may vary based upon factors including:

  • Property size

  • Property type

  • Location

  • Travel requirements

  • Selected services

  • Number of photographs

  • Additional editing

  • Additional media

  • Special requests

EE Imagery may change its prices at any time. Price changes will not ordinarily alter the price of services already confirmed unless the scope of the project subsequently changes.

15. PAYMENT

Payment terms are provided during booking or invoicing.

Unless alternative arrangements have been approved by EE Imagery, payment is due according to the terms stated on the applicable invoice or booking.

The Client is responsible for all authorized charges associated with the services ordered.

Additional services or work requested after the original booking may result in additional charges.

EE Imagery may withhold final deliverables, download access, licensing rights, or future services while an account has an outstanding balance.

16. IMAGE DELIVERY

EE Imagery generally strives to provide prompt delivery of completed real estate photography.

Estimated delivery times are estimates rather than guarantees unless EE Imagery specifically agrees otherwise in writing.

Delivery time may be affected by:

  • Project size

  • Services ordered

  • Editing requirements

  • Internet or hosting outages

  • Third-party processing

  • Weather

  • Technical problems

  • Holidays

  • Unusually high workload

  • Circumstances beyond our reasonable control

Media may be delivered electronically through an online gallery, download link, Matterport link, email, or another digital delivery method.

Clients should download and appropriately archive delivered files.

17. REVISIONS AND CORRECTIONS

If you believe delivered media contains an editing error or does not correspond to the services ordered, please contact EE Imagery promptly.

We will review reasonable correction requests.

Standard corrections may include issues such as:

  • Color balance

  • Exposure

  • Perspective

  • Minor editing errors

  • Incorrectly delivered files

Requests that constitute additional retouching, a change in artistic preference, extensive object removal, or services outside the original order may incur an additional fee.

18. RESHOOTS

A complimentary reshoot is not automatically provided because of circumstances outside EE Imagery's control, including:

  • Property not being photography-ready

  • Staging changes made after photography

  • Landscaping changes

  • Construction work

  • Vehicles or personal property left at the property

  • Changes requested by the seller or agent after completion

  • Weather preferences when photography was otherwise reasonably completed

If EE Imagery determines that a reshoot is necessary because of a material error attributable to us, we will work with the Client to provide an appropriate remedy.

19. COPYRIGHT

Unless expressly agreed otherwise in writing, EE Imagery retains the copyright and ownership of all photographs and media it creates.

Payment for photography or media services does not transfer copyright ownership to the Client.

Instead, upon full payment, the Client receives a license to use the delivered media as described in these Terms.

20. REAL ESTATE MARKETING LICENSE

Upon full payment, EE Imagery grants the Client a limited, non-exclusive, non-transferable license to use the delivered media for the marketing of the property for which the media was originally commissioned.

Permitted uses generally include:

  • MLS listings

  • Brokerage websites

  • Agent websites

  • Property websites

  • Social media

  • Digital advertising

  • Printed property marketing

  • Flyers and brochures

  • Email marketing

  • Other marketing directly associated with the listing

Unless otherwise agreed, the license is intended for the Client and the marketing of the commissioned property.

21. PROHIBITED OR ADDITIONAL USE

The Client may not sell, sublicense, or transfer EE Imagery media to an unrelated third party for independent commercial use without authorization.

Additional licensing may be required for use by:

  • Builders

  • Architects

  • Interior designers

  • Contractors

  • Developers

  • Hotels

  • Publications

  • Product manufacturers

  • Advertising agencies

  • Subsequent listing agents

  • Other businesses seeking to use the photographs for their own commercial purposes

Such parties should contact EE Imagery regarding appropriate licensing.

22. PORTFOLIO AND PROMOTIONAL USE

Unless otherwise agreed in writing, EE Imagery may use photographs and media we create for our own legitimate promotional purposes, including:

  • Our website

  • Portfolio

  • Social media

  • Printed marketing

  • Demonstrations of our services

  • Advertising

  • Competitions or professional presentations

We will make reasonable efforts to avoid publishing confidential information provided by the Client.

If a property requires confidentiality or should not be used in our portfolio, the Client should notify EE Imagery before the photography session.

23. MLS AND ADVERTISING COMPLIANCE

The Client is responsible for ensuring that their use of photographs, floor plans, virtual twilight images, digitally modified photographs, Matterport tours, and other media complies with:

  • Applicable MLS rules

  • Brokerage requirements

  • Advertising regulations

  • Disclosure requirements

  • Applicable laws

EE Imagery does not control the rules of individual MLS organizations, brokerages, or advertising platforms.

24. THIRD-PARTY SERVICES

Some EE Imagery services rely upon third-party providers, which may include website hosting, image delivery, payment processing, Matterport, mapping, cloud services, or other technology platforms.

We cannot guarantee the continuous availability or operation of systems controlled by third parties.

Temporary interruption or discontinuation of a third-party service does not constitute a breach by EE Imagery when the circumstances are outside our reasonable control.

25. SAFETY

EE Imagery personnel are not required to enter or remain in any location they reasonably believe presents a safety hazard.

Potential hazards may include:

  • Unsafe structures

  • Aggressive animals

  • Hazardous materials

  • Active construction

  • Unsafe electrical conditions

  • Severe weather

  • Unsafe roof or elevated access

  • Threatening behavior

  • Other hazardous conditions

The photographer may stop work and leave the property when necessary to protect personal safety or equipment.

26. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, EE Imagery will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our services or website.

To the fullest extent permitted by applicable law, EE Imagery's aggregate liability arising from a particular photography or media project will not exceed the amount actually paid to EE Imagery for the service giving rise to the claim.

Nothing in these Terms is intended to exclude liability that cannot lawfully be excluded or limited.

27. FORCE MAJEURE

EE Imagery will not be responsible for delays or inability to perform caused by circumstances reasonably beyond our control, including severe weather, natural disasters, power or internet outages, governmental restrictions, emergencies, illness, transportation disruption, equipment failure despite reasonable precautions, third-party platform outages, or similar events.

We will make reasonable efforts to reschedule or complete affected services.

28. PRIVACY

Information collected through our website, booking process, and services is handled in accordance with our Privacy Policy.

Our Privacy Policy should be read together with these Terms of Service.

29. GOVERNING LAW

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.

Any rights available to consumers under applicable Massachusetts or federal law remain unaffected where those rights cannot lawfully be waived.

30. CHANGES TO THESE TERMS

EE Imagery may update these Terms periodically to reflect changes to our services, business practices, pricing structure, technology, or legal requirements.

The current version will be posted on our website with the applicable Last Updated date.

Terms applicable to an existing confirmed order will generally be those in effect when the order was placed unless otherwise agreed or required by law.

31. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

32. ENTIRE AGREEMENT

These Terms, together with the applicable booking confirmation, invoice, service description, Privacy Policy, and any written agreement between EE Imagery and the Client, constitute the agreement governing the applicable services.

If a separately executed written agreement expressly conflicts with these Terms, the separately executed agreement will control with respect to that conflict.
